The item(s) offered by BattMech for sale on this website being purchased by Purchaser and may also be referred to as “item” or “items”. 1. Disclaimer; Assumption of Risk; Waiver and Release. By entering into this Agreement, Purchaser acknowledges that there are certain dangers, hazards, and risks inherent in replacing and or using Product(s) offered by BattMech in a hybrid or electric vehicle and in all activities, Purchaser undertakes, in connection therewith Products offered by BattMech including but not limited to Battery Pack(s). BattMech does not provide installation or other services in connection with the Products, and therefore: (a) BattMech hereby disclaims any and all liability to Purchaser for, and Purchaser fully assumes all risk of, personal injury, death, or property damage arising out of or attributable to Purchaser’s use of the purchased Product(s) including, without limitation, Purchaser’s installation, removal, handling, or modification of such product(s); and (b) Purchaser waives and releases any and all claims on account of personal injury, death, or property damage against BattMech, its subsidiaries, affiliates, divisions, DBA’s, shareholders, officers, employees, and contractors, arising out of or attributable to Purchaser’s use of the purchased Product(s) including, without limitation, Purchaser’s installation, removal, handling, or modification of such Product(s). Indemnification. Purchaser agrees to indemnify, defend, and hold harmless BattMech and its subsidiaries, affiliates, division’s, DBA’s, shareholders, officers, employees, and contractors, from any and all liabilities, claims, actions, damage, losses, fines, penalties, costs or expenses of any kind, including, without limitation, reasonable attorney’s fees, arising from or in connection with Purchaser’s use and or handling of the Products. 3. Limited Product Warranty. Purchaser acknowledges and accepts the terms of any applicable limited warranty for the Product which can be found below in the section titled Limited Product Warranty (the “Warranty”).” 4. Core Return. a) Purchaser agrees to return and exchange core that Purchaser is replacing with new Battery Pack to BattMech. If the core is not returned within 30 days from purchase date, a fee of the amount you would have been billed for the make, model, and year of the battery you purchased will be billed to Purchasers credit card on file. If no card can be billed for any reason an invoice will be sent via email and/or via mail to the address/es on file. BattMech will charge Purchaser interest at a rate of 1.5% per month (or the highest rate permitted by law, if less) on all overdue payments for not paying the core charge for an unreturned core within 30 days of receiving an invoice from BattMech and make Warranty void. b) Purchaser agrees to surrender all rights to the Core Purchaser exchanges into BattMech and Core becomes property of BattMech once received by BattMech. Purchaser will have no rights to the Core once received by BattMech. If Purchaser exchanges Core and then returns Battery Pack purchased from BattMech within 30 days from purchase date, for any reason, BattMech may return Purchasers Core to Purchaser at BattMech’s sole discretion. Purchaser understands and acknowledges BattMech is not responsible for any damage that may occur or may have occurred in the shipping processes of Core to BattMech or from BattMech. If BattMech, at its sole discretion, returns Core to Purchaser, there is no guarantee that the Core will work for Purchaser or that it is the same Core sent to BattMech in exchange for purchasing Battery Pack. Purchaser makes no claim and has no claim Core was sent to BattMech in a working condition, especially since Purchaser is buying a Battery Pack to replace a Core. If Purchaser purchases a Battery Pack from BattMech and later finds that Battery Pack did not fix the Purchasers vehicle, the Purchaser is aware and understands fully that Purchaser has no claim to Core they exchanged for Battery Pack and that being without a Battery Pack or Core may leave Purchaser without a Battery Pack or a Core for Purchasers vehicle and that vehicle may not be operational without a Battery Pack or Core. c) Purchaser is fully aware of Subsection b. of Section 4. LIMITED WARRANTY COVERS RESIDENTIAL VEHICLE USE ONLY. THIS WARRANTY DOES NOT COVER VEHICLES USED IN COMMERCIAL USE. Terms of the limited warranty are as follows: Definitions: a) Core: Original battery modules/cells that are coming out of the battery case that need replacing. Coverage: The 24 Month or 50,000 Mile Battery Pack Limited Warranty covers any battery pack used in a residential vehicle if battery pack fails due to defects in materials or workmanship of battery pack, under normal installation, use and service, during the warranty period. It does not cover a battery pack that is used for commercial use in any way. For any claim covered by this warranty, BattMech, at its discretion, will arrange for the repair of defective battery pack or replacement with a battery pack of comparable quality, or will refund claimant for the original cost minus fees and shipping costs, of the purchase, at BattMech’s option if battery pack is deemed a be a good warranty claim by BattMech. 2. Does Not Cover: This warranty does not cover any other component or part of the vehicle, whether it is part of the hybrid system or not, battery packs that are merely discharged, or that fail due to abuse, misuse, neglect, fire, accident, collision, explosion, freezing, theft, overcharging, alteration, improper installation, used for something other than its intended use, unauthorized attempt to repair, failure to keep the battery properly maintained, and/or consequential and incidental damages (include, but are not limited to): loss of income, loss of use, towing charges, diagnostic fees, rental costs, transportation costs, installation, or removal costs by yourself or a third party, damage to property, or injury to people). Two (2) Week Requirement: Within two weeks of purchase of battery pack, you are required to send a photo of the actual milage on the vehicle odometer of vehicle that battery pack was installed to BattMech via eBay communication. Please include the vin # of the vehicle in which battery was installed and the battery serial number on the pack you purchased with the photo. 5. Verification/Shipping Non-Refund: Refund, repair, or replacement of failed battery pack will be issued once BattMech receives and verifies condition of failed battery pack for claim legitimacy. Return shipping cost and arrangement to BattMech of failed battery pack for claim are the claimants responsibility and these costs will not to be refunded by BattMech. 6. Specific Limitations: Any of the following situations will not be covered and will void this warranty: a) Installed the battery without following BattMech’s installation instruction. b) If the vehicle has not been started and driven for at least 30 minutes every 30 days. c) Damage to the Battery Pack due to vehicle accident or improper installation by yourself or a third party. d) If the Battery Pack has had direct exposure to water. e) If the Battery Pack Battery has been misused or abused. Misuse and abuse include the influence of any component of the hybrid system that causes the Battery Pack to be utilized in a manner that exceeds manufacturer specifications. f) If the Battery Pack Battery has depleted to less than 20% State of Charge (SOC) due to running out of fuel, engine or regenerative system malfunction, or user error. An example of user error is leaving the vehicle in neutral for extended periods while vehicle turns on. In this example, the engine is unable to recharge the Battery Pack Battery which may result in permanent damage. g) If the Battery Pack Battery has been tampered with, opened, or disassembled, or removed from the vehicle after installation other than removal for repairs or service to other parts of the vehicle. h) If the Battery Pack Battery has depleted to less than 20% State of Charge (SOC) due to running out of fuel, engine or regenerative system malfunction, or user error. An example of user error is leaving the vehicle in neutral for extended periods while vehicle turns on. In this example, the engine is unable to recharge to the Battery Pack Battery that may result in permanent damage. i) The presence of any of the following diagnostic codes: P3191 (Engine Does Not Start), P3193 (Fuel Run Out), P3190 (Poor Engine Power), P0A0F (Engine Failed to Start), C1256 (Accumulator Low Pressure), or their equivalent manufacturer diagnostic code. These diagnostic codes indicate the vehicle is unavailable to recharge the Battery Pack Battery that will lead to permanent damage. j) The presence of any of the following diagnostic codes: P3191 (Engine Does Not Start), P3193 (Fuel Ran Out), P3190 (Poor Engine Power), P0A0F (Engine Failed to Start), C1256 (Accumulator Low Pressure), or their equivalent manufacturer diagnostic code. These diagnostic codes indicate the vehicle is unavailable to recharge the Battery Pack Battery that will lead to permanent damage. k) Battery Pack has been CHARGED or DISCHARGED prior to installation into a vehicle. l) Battery Pack was not installed by a certified automobile repair technician. 7. Core Return: Warranty will be made void if Core is not returned to BattMech within 30 days from purchase date from BattMech of New Aftermarket battery pack unless you take the option to not return the Core and instead pay the fee for not returning a Core when checking out. 8. Customer must offer the below information to BattMech for evaluation of warranty claim: a) Error code after scanned by OBD 2 (picture/Screen). b) Battery Volt reading by OBD 2. c) Battery code print in each module (Picture). d) Description of what happens to the car when the issue arises. e) Driving Mileage (If battery installed already). f) Installation Date (If battery installed already). g) Car Make, Model, Year and VIN Number. h) Multiple pictures of the battery installed, of the pack, and from various angles. i) Name, and Phone Number used to purchase battery pack. j) Battery Pack Serial Number. Failure to offer this information may void warranty or warranty claim. 9. Please Note: a) All battery packs need to be assembled in order according to the serial number printed on the battery modules. b) All warranty claims must be communicated to BattMech as soon as possible to ensure the fastest service possible, and to qualify for your warranty claim. All claim information must be provided to BattMech through ebay within 2 weeks of battery failing.
